PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING OUR SERVICES. BY BROWSING, PROVIDING YOUR EMAIL OR PHONE NUMBER, OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THE TERMS OF THIS POLICY.
1. Service Description & Product Nature
MelodyAmor is a digital automation platform designed to generate personalized custom songs using Artificial Intelligence. The final product is a 100% digital custom audio file delivered electronically by email. The service operates strictly digitally, and no physical media of any kind is shipped or delivered.
2. User Inputs & Creative Controls
To generate a custom song, the client provides specific details, stories, and style preferences in the site configurator. The system uses third-party AI language models to draft the song lyrics. The client has the right to review, edit, and save the final lyrics directly on the configurator screen before audio generation begins. The final audio will be based strictly on the approved and saved lyrics.
3. Delivery Estimates & Service Level Agreement (SLA)
The platform offers two different delivery options: (i) Standard Delivery (normal queue), with an estimated completion time of up to 24 hours; and (ii) Express Delivery (prioritized queue), with an estimated completion time of up to 2 hours. Delivery timelines begin only after payment is successfully confirmed by Stripe.
4. Computational Gifting Costs & No-Refund Policy
Creating and rendering personalized custom songs consumes third-party AI APIs and cloud processing resources in real time. Since the song is a customized digital good made to order based on the user’s specific guidelines, and because rendering triggers irreversible costs, NO REFUNDS or chargebacks will be granted once audio generation has begun. Legal regret periods do not apply to customized digital goods already fully produced or in process.
5. License of Use & Copyright
The customer is granted a perpetual, worldwide, non-exclusive license to play, download, and share the final custom song for strictly personal, recreational, or family purposes (such as birthday celebrations, weddings, tributes, or personal social media uploads without monetization). Commercial, corporate, promotional, or paid distribution on music streaming services is strictly prohibited unless a Corporate/Jingle package is selected and paid for.
6. Revision and Adjustments Policy
To ensure user satisfaction while preserving automated system stability, customers may request up to 2 (two) free automated revisions or regenerations to refine minor aspects of the generated song. Revision requests that modify the core storyline or input responses from the original order will not be processed under the original payment.
7. Limitations of AI Technology
MelodyAmor uses statistical and probabilistic AI models to generate lyrics and render audio. Consequently, minor rhythmic inconsistencies, vocal mispronunciations, or lyrical errors ('AI hallucinations') may occur. By approving the lyrics and creative direction before payment, the customer acknowledges this operational nature. MelodyAmor is not liable for third-party API downtime or electronic delivery delays caused by temporary email provider or network infrastructure outages.
8. Acceptable Content Use
The user agrees not to submit stories, inputs, or names containing hate speech, harassment, explicit sexual violence, child exploitation materials, or any prompts that violate the terms of service of our integrated AI providers. MelodyAmor reserves the right to reject and cancel orders violating these guidelines without a refund if computative triage costs have already been incurred.
9. Electronic Communications, Messaging, and Newsletter
By providing an email address or phone number, the customer authorizes us to send the electronic and messaging communications necessary to fulfill the service, including order confirmations, status updates, checkout recovery reminders, operational notices, and support messages. When the user has given specific consent or another lawful basis applies, MelodyAmor may also send news, new product announcements, informational campaigns, and newsletters by email, SMS, or messaging apps linked to the provided phone number. The customer may opt out of promotional communications at any time without affecting essential transactional messages needed for billing, security, delivery, and service support.
10. Updates to These Terms
MelodyAmor may update, revise, or supplement these Terms of Service at any time, at its sole discretion, to reflect operational, legal, technical, or commercial changes. When a material update occurs, we will publish the new version on this page with the corresponding date. Continued use of the platform after the changes are published means acceptance of the current version. We recommend reviewing these Terms periodically.
11. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Federative Republic of Brazil. For any dispute arising from the use of this service, the parties consensually select the exclusive jurisdiction of the courts of Fortaleza, State of Ceará, Brazil, waiving any other venue.
